Did we bounce an election?

New Free Press article:

Did we bounce an election?

I'll admit it; my checkbook is not very tidy.  Like many people, I don't scrupulously reconcile my bank statements and I don't record every trip to the ATM or check card purchase the way my dad taught me.  Usually everything works out fine but every once in a while I bounce a check and suffer the consequences of my sloppiness.   It seems our public officials are being just as reckless with our votes.  An examination of the New Mexico canvass report of the November 2 election suggests that the state might be running the risk of bouncing an election.

The canvass report (available as a pdf from the Secretary of State's website
http://www.sos.state.nm.us/Election/cntyindx04.html) is the official record of the election results.  It is certified by the state Canvassing Board (consisting of Governor Bill Richardson, Secretary of State Rebecca Vigil-Giron and Supreme Court Chief Justice Patricia Maes) and is used as the basis for determining who will represent the people of New Mexico in public offices and, in a presidential election, which slate of electors will be chosen for the Electoral College. With so much at stake, one would expect the canvass report to be a lot cleaner than my checkbook. That is not the case.

Free Press: non-recount ends

New in the Free Press

Ohio's official non-recount ends amidst new evidence of fraud, theft and judicial contempt mirrored in New Mexico

COLUMBUS -- The Ohio presidential recount was officially terminated Tuesday, December 28.

But the end comes amidst bitter dispute over official certification of impossible voter turnout numbers, over the refusal of Ohio's Republican Supreme Court Chief Justice to recuse himself from crucial court challenges involving his own re-election campaign, over the Republican Secretary of State's refusal to testify under subpoena, over apparent tampering with tabulation machines, over more than 100,000 provisional and machine-rejected ballots left uncounted, over major discrepancies in certified vote counts and turnout ratios, and over a wide range of unresolved disputes that continue to leave the true outcome of Ohio's presidential vote in serious doubt.

Second recount and Jesse Jackson interview

Candidates Want Second Ohio Recount

COLUMBUS, Ohio - Two third-party presidential candidates asked a federal court Thursday to force a second recount of the Ohio vote, alleging county election boards altered votes and didn't follow proper procedures in the recount that ended this week.

Also, in Newsweek, an interview with Jesse Jackson:

Ohio Action Memo

Thank you Monica for posting this in the Blog for America comments:

Important Ohio Action Memo from Progressive Democrats of Illinois
I know you are getting millions of e-mails, sorry for another but I wanted to add some info and I wanted to encourage you to keep up the pressure on Congress, we only have 1 week to go!!! There is an urgent need for some donations to the Ohio legal battles go to www.Freepress.org and click on the Donate word on the right column. There is also an urgent need for funds to get the suppressed voters to Wash, DC go to www.donotconcede.com . Then there is a need for funds for the Jan 6th rally at www.patrioticoutrage.com . I hope everyone is seriously thinking about either the Jan 3rd Columbus, OH rally, 2pm, (indoors), go to www.rainbowpush.org for more info and/or the Jan 6th rally, 10am outside the Capitol Bldg. for the Challenge, go to www.patrioticoutrage.com ! If you want transportation info go to www.51capitalmarch.com or if in Illinois e-mail me at drlora@ameritech.net

Senator Byrd got many visits today and I think he is 1 of the Senators who will come through for us. Please try to call him at the 1-800-839-5276 but if his office is closed then fax him at 1-202-228-0002, make sure you add why the major media is blocking this story! Byrd is an older guy, as we all know, he may still be deluded about the independence of the press in America. I can tell because his aide, Ms. Barth has asked for faxed copies of real news articles on the fraud from the major press, especially the NYT and the Wash Post. She does not want electronic copies, if you have any laying around please fax them to her at 304-343-7144 and then fax a letter to the other number above, try to keep it to 2 pages or less!!!

Many of the Senators offices are closed that is why we are going to local actions, they are having vigils outside Kerry's home every day in Mass, we are going to Obama's going away party tomorrow night here in Chicago to give him a message and pass out flyers! So the phone calls are probably not going to get through to the Senators until Jan 3rd. So I am asking everyone to start faxing the Senators and then on Jan 3rd you can go back to calling, 1-800-839-5276!

Please make the letters short, just tell them that you no longer trust the integrity of our Democracy, you and 40 million other Americans, per Zogby, believe that this election was stolen in a widespread electronic coup! Ask them to sign the challenge so that we can start the process of real election reform in this country by having a national debate. Tell them that we will need a full House Judicial Committee investigation and then criminal investigations as warranted from there. Tell them that you are sick and tired of having elections where you can not trust the outcome, tell them PAPER BALLOTS counted at the precinct level are the absolute safest, no more giving our Democracy away to the corporations; ALL THE MACHINES CAN BE HACKED, DISTRIBUTED POORLY and MALFUNCTION as per the hundreds of thousands of reports of irregularities that have poured in since Nov 2nd! We do not have to prove all the fraud, we just have to tell them how we feel knowing that America is really a dictatorship, where a small group of individuals can steal the Presidency over and over! Write 1 letter and just change the heading for each Senator. Thank you for all of your work to Defend our Democracy!

Ohio Judge to Remain on Vote Challenge

From the comments

Ohio Judge to Remain on Vote Challenge

"Moyer called the voters' claim "wholly without foundation." He added that he has no reason to remove himself since the challenge doesn't involve his own election and he has nothing to gain by a change in the results.

Moyer also rejected the voters' requests for a speedy hearing and an order that elections boards preserve evidence from the election."

so if i understand correctly the rights to a fair and speedy trial have been revoked?

sigh, f

Open letter to Kerry by Bob Fertik

Yeah, I heard that the recount is over. I even heard from our local alternative newsweekly that it is "time to get on with our lives". Man, wouldn't I like to? But I kind of like this election thoroughly investigated, especially the role of Kenneth Blackwell, who plans to run for governor in 2006. Man, I'm tired, though. But if people are still out there working on this thing, I suppose I should take the time to report on it. If nothing else, there need to be voices reminding the world that our selfish, stubborn, fake Christian president who didn't want to interrupt his vacation to respond to the devastation caused by the tsunamis, does not have a mandate.

Bitter? Yep. But Bob Fertik took the time to write this open letter to John Kerry, so I'm going to post a link to it. Maybe my attitude will be better tomorrow.

An Open Letter to Senator John Kerry on Irregularities, Fraud, and Conspiracies

Dear Senator Kerry,

I was proud to support you in every way possible this year, including casting an enthusiastic vote for you in New York.

Since the polls closed on November 2, I have carefully monitored the counting and recounting of votes in Ohio, and the independent investigations of possible fraud.

Monday afternoon, your attorney Don McTigue joined John Bonifaz in two important motions to preserve and augment evidence of such fraud in the November election, stemming from Triad's actions in Hocking County.

But Monday night, your attorney Dan Hoffheimer told Keith Olbermann your investigation is over:

Kerry Files Motion to Protect Ohio Vote Evidence

In Truthout:

Kerry Files Motion to Protect Ohio Vote Evidence

This afternoon, an attorney representing the Kerry/Edwards presidential campaign filed two important motions to preserve and augment evidence of alleged election fraud in the November election. The motions were filed in the matter titled Yost et al. v. Delaware County Board of Elections and J. Kenneth Blackwell (Civil Action No. C2-04-1139) with the U.S. District Court for the Southern District of Ohio. The document is titled "Motion Of Intervenor-Defendant Kerry-Edwards 2004, Inc. For A Preservation Order And For A Leave To Take Limited Expedited Discovery."

Blackwell seeks court order to avoid interview

From an article in the Guardian Unlimited
Secretary of State Kenneth Blackwell has requested a protective order to prevent him from being interviewed as part of an unusual court challenge of the presidential vote.

Blackwell, in a court filing, says he's not required to be interviewed by lawyers as a high-ranking public official, and accused the voters challenging the results of ``frivolous conduct'' and abusive and unnecessary requests of elections officials around the state.

Blackwell's role becomes clearer

In the Cobb/LaMarche Daily Update

Blackwell's Role Becoming Clearer

As more county recount reports flow into our office, it is becoming clearer that Secretary Blackwell's office had a direct role in making it harder to vote in Ohio and harder to recount the vote.

For example, the new Champaign County report describes how the precinct signature book, necessary to verify that the number of votes that were cast, will not be made available to our recount observers until after January 10, per orders of the Secretary of State (and, of course, Congress convenes on January 6 to receive the Electoral College votes, so irregularities discovered after that date are old news).

Another fact to emerge from the recount reports is that no one can say for sure whether the state-wide vote totals are accurate, because the "chain of custody" of vote tabulators and even paper ballots has been compromised by unsupervised access given to machine technicians.

Cobb/LaMarche Daily Update for more information. You can also check out their Ohio Recount Blog.
